IP Infringement Policy

1. Overview
AutoFBA respects the intellectual-property rights of others and expects our users to do the same. This policy explains:
- how to report copyright infringement under the Digital Millennium Copyright Act (DMCA);
- how to report trademark infringement or brand abuse;
- how we handle counter-notifications;
- how we treat repeat infringers;
- what AutoFBA does — and does not — do to verify that products you list on Amazon are authorised for sale.
2. AutoFBA's Role vs. the Seller's Role
AutoFBA surfaces product and supplier suggestions using AI, public catalogue data, and the Amazon Selling Partner API. We do not verify on your behalf:
- whether you have authorisation from the rights holder to resell a branded product;
- whether a category, brand, or ASIN is gated or restricted on a given Amazon marketplace;
- whether a supplier’s offer is genuine, parallel-imported, counterfeit, or otherwise unauthorised;
- whether a listing’s images, copy, or A+ content infringe a third party’s rights.
Before you source, list, or run advertising for any product, you must verify authorisation independently. AutoFBA suggests opportunities; the seller decides what to actually buy and list.
3. Copyright Infringement — DMCA Notice
If you believe in good faith that material accessible through the AutoFBA service (for example, an image, video, or document uploaded to our Content Library or a user-generated listing asset) infringes your copyright, you may submit a DMCA notice to our designated agent at the address below.
3.1 Required contents of a notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorised to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works).
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (a URL is best).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
3.2 Designated agent
Send notices to ip@autofba.ai with the subject line “DMCA Notice.” We acknowledge receipt within two business days.
Misrepresentations in a DMCA notice may subject you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f). Consult a lawyer if you are unsure whether material is infringing.
4. Counter-Notification
If we remove or disable access to material in response to a DMCA notice and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notice containing:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the judicial district of Delaware), and that you will accept service of process from the person who provided the original notice or an agent of that person.
Send counter-notices to ip@autofba.ai. We will forward a copy to the original complainant and may restore the removed material in 10–14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the alleged infringer.
5. Trademark and Brand Concerns
If you believe content on AutoFBA infringes a trademark, brand, design, or other non-copyright intellectual-property right, send a notice to ip@autofba.ai with:
- your name, role, and the rights holder you represent;
- the registered mark or right at issue (registration number and jurisdiction where available);
- the URL or location of the allegedly infringing content;
- a description of why the use is unauthorised;
- your contact details and a good-faith statement.
For complaints about a product listed on Amazon itself, we encourage you to use Amazon’s Brand Registry and Report Infringement tools, as Amazon controls the marketplace listing surface; AutoFBA can only act on content hosted on our own service.
6. Repeat Infringer Policy
AutoFBA will, in appropriate circumstances and at our discretion, suspend or terminate the accounts of users who are repeat infringers, in accordance with 17 U.S.C. § 512(i). A “repeat infringer” includes any user against whom multiple validated infringement notices have been filed and not successfully counter-noticed.
7. Counterfeit and Restricted Products
The sale of counterfeit goods is prohibited by Amazon’s policies and by law. You may not use AutoFBA to:
- list, source, or advertise counterfeit, replica, or knockoff products;
- infringe a registered trademark or design by listing a confusingly similar product;
- use brand names, logos, or product images in listings, ads, or A+ content without authorisation;
- source from suppliers known or suspected to traffic in counterfeit goods.
Suspected counterfeit activity will be referred to Amazon and, where appropriate, to the rights holder and to law enforcement.
8. Brand-Gating and Authorised Reseller Status
Many brands on Amazon are gated, meaning a seller must obtain permission and submit documentation before listing those brands. AutoFBA does not verify or grant gating approval. Before sourcing a branded product surfaced by AutoFBA you should:
- check whether the brand or category is gated on your target marketplace;
- confirm you can obtain authentic, invoiced product from an authorised distributor or directly from the brand;
- retain invoices and authorisation letters as Amazon may request them at any time;
- monitor Amazon’s Account Health and IP complaints dashboard after listing.
9. AI-Generated Listing Content and IP
Listing copy, A+ content drafts, keyword suggestions, and image mock-ups generated by AutoFBA’s AI features may inadvertently include phrases, descriptions, or stylistic elements that overlap with third-party material. You are responsible for reviewing AI-generated content for IP issues before publishing it to Amazon, your storefront, or any advertising surface.
